Important information
These website terms provide general information about using this website. Specific client projects may be governed by separate proposals, statements of work or service agreements. If there is a conflict, the relevant signed or otherwise accepted project agreement will determine the terms of that project to the extent stated in that agreement and permitted by law.

Our contact details are:

02 Acceptance of Terms

By accessing or using this website, you agree to comply with these Terms of Service to the extent they apply to your use of the website.

If you enquire about or purchase our services, additional terms may apply. Those terms may be set out in a written proposal, quotation, statement of work, service agreement or other document accepted by you and Nextera Solutions.

If you do not agree with these website terms, please discontinue use of the website. Nothing in these terms removes or restricts any rights you have under applicable law that cannot lawfully be excluded or restricted.

03 Our Services

The services available from Nextera Solutions may include:

  • Website planning, design, development and redesign.
  • WordPress websites and related website functionality.
  • E-commerce website development and online shop support.
  • Digital marketing and social media campaign services.
  • Graphic design, visual assets and branding.
  • Other digital services agreed with a client.

The exact services, deliverables, milestones, timescales, fees and any ongoing support will be confirmed separately where required. We will explain any material limitations or dependencies that are relevant to the agreed work.

We may update the information describing our services on this website. A change to website content does not automatically change an existing project agreement.

04 Quotes and Project Scope

Any estimate or quotation will be based on the information available at the time it is prepared. Unless a quotation states otherwise, it is not a binding commitment until accepted in the manner specified in that quotation.

Before work begins, the project scope should identify the relevant deliverables and, where appropriate, the agreed price, payment schedule, expected timescale, revision allowance and client responsibilities.

Requests outside the agreed scope may require a revised quotation, an additional fee or a change to the delivery schedule. We will seek agreement to material changes before proceeding with additional chargeable work.

Illustrations, examples and portfolio materials on our website are provided for general information. They do not guarantee that a particular feature, design or result will be included in your project unless it is agreed separately.

05 Fees and Payments

The fees for a project will be stated in the relevant quotation or agreement. Any deposit, instalment schedule, recurring charge, applicable tax or additional expense should be identified before the relevant commitment is made.

Payment terms

Clients must pay invoices in accordance with the payment terms agreed for their project. If a payment is overdue, we will contact the client to seek resolution. Where permitted by the agreement and applicable law, we may suspend affected work after giving any notice required.

Additional work and expenses

Work outside the agreed scope, third-party subscriptions, paid themes, plugins, stock assets, advertising spend, hosting, domain registration and other external costs are not included unless expressly stated in the quotation. We will clarify responsibility for relevant costs before they are incurred where reasonably practicable.

Late payment

Where legally permitted, interest or recovery costs may be charged on overdue business invoices in accordance with the applicable agreement and law. We will not apply charges where doing so would be unlawful.

06 Client Responsibilities

To help us deliver a project, clients agree to cooperate reasonably and provide the information, materials, decisions and access needed for the agreed work.

This may include:

  • Providing accurate business information and content.
  • Supplying logos, images, product details and other required assets.
  • Ensuring they have permission to use materials supplied to us.
  • Providing required approvals and feedback within agreed timescales.
  • Providing appropriate access to relevant website or platform accounts.
  • Reviewing deliverables and notifying us of identified issues.

Clients remain responsible for the accuracy, legality and permissions associated with materials they supply, subject to any responsibilities imposed on us by law or agreed in writing.

If information, approvals or access are delayed, project milestones may need to be revised. We will communicate material effects on delivery where reasonably practicable.

07 Changes, Revisions and Delays

The number and type of revisions included in a project will be set out in the relevant quotation or agreement, where applicable.

Significant changes to approved designs, content, functionality or project requirements may affect the price and delivery schedule. We will explain the expected impact and seek agreement before carrying out additional chargeable work.

We will make reasonable efforts to meet agreed timescales. However, delivery dates may be affected by late client feedback, changes in scope, third-party services or events beyond our reasonable control. Where this happens, we will communicate the issue and discuss a practical way forward.

08 Intellectual Property

Client-supplied materials

Clients retain their rights in materials they own and provide to us. They grant us permission to use those materials as reasonably necessary to perform the agreed services.

Project deliverables

Ownership and usage rights for designs, code, graphics, written content and other project deliverables will be determined by the relevant project agreement. Where no separate arrangement applies, any transfer of rights in bespoke deliverables created for a client will be subject to the agreed payment terms and any applicable third-party rights.

Pre-existing and third-party materials

Tools, frameworks, reusable components, software, typefaces, stock images, plugins and other third-party materials may be subject to separate licences or restrictions. These rights do not automatically transfer to the client.

Portfolio use

We will not assume permission to publish confidential client materials or identify a client in our portfolio. Any portfolio display or public case study will be subject to the permissions and arrangements applicable to the project.

09 Third-Party Services and Platforms

Some projects may rely on third-party services, such as hosting providers, domain registrars, payment processors, analytics tools, advertising platforms, content management systems, marketplace services or software plugins.

Those services may have their own terms, fees, security requirements and privacy policies. Unless expressly agreed otherwise, Nextera Solutions does not control the operation, availability, pricing or policies of independent third-party providers.

We will take reasonable care when working with relevant third-party services, but we cannot guarantee that an independent provider will remain available or unchanged. Where possible, we will discuss material dependencies and alternative options with the client.

10 Acceptable Use of This Website

You may use our website only for lawful purposes. You must not:

  • Use the website in a way that breaches applicable law or regulation.
  • Attempt to gain unauthorised access to the website, server or related systems.
  • Knowingly introduce malicious code or interfere with website security.
  • Use our website to transmit fraudulent, unlawful or harmful material.
  • Copy, reproduce or commercially exploit protected website content without permission, except where permitted by law.

We may take reasonable steps to protect the website and its users if we identify misuse or a security risk. Nothing in this section restricts any activity that applicable law expressly permits.

11 Confidentiality and Privacy

Where we receive confidential information in connection with a project, we will handle it in accordance with applicable legal obligations and any confidentiality arrangements agreed with the client.

We process personal information in accordance with applicable data protection law and the information described in our Privacy Policy.

Please read our Privacy Policy for details about the personal information we collect, how it is used, the relevant legal grounds and the rights available to individuals.

If a project involves processing personal data on behalf of a client, additional data protection terms may be required depending on the roles of the parties and the nature of the processing.

12 Warranties, Availability and Results

We aim to provide our services with reasonable care and skill and in accordance with the applicable project agreement and legal obligations.

Unless expressly agreed in writing, we do not guarantee specific commercial outcomes, search engine rankings, website traffic, advertising performance, sales, conversions, social media engagement or revenue. These outcomes can depend on factors outside our control.

We also do not guarantee that this website will always be available without interruption or error. We may need to update, maintain or temporarily restrict access to parts of the website.

Nothing in these terms excludes a guarantee, condition, statutory right or other protection that cannot lawfully be excluded.

13 Limitation of Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and any other liability that cannot legally be excluded or limited.

Where permitted by law, neither party will be liable to the other for losses that are not reasonably foreseeable consequences of the relevant breach. This provision does not apply where such a restriction would be unlawful or conflict with mandatory legal rights.

Any agreed financial limit on liability for a client project should be set out in the relevant project agreement and must comply with applicable law, including any mandatory protections available to consumers.

Nothing in this section removes or restricts your statutory rights as a consumer or any rights that cannot legally be limited.

14 Cancellation, Suspension and Termination

If you wish to cancel a project or service, please contact us using the details in Section 18. The applicable cancellation procedure, notice period, outstanding fees and treatment of work already completed will depend on the agreement and applicable law.

If a party materially breaches a project agreement, the other party may have rights to request that the breach be remedied or to terminate the agreement, subject to the agreement and applicable law.

We may suspend affected work where reasonably necessary to address a security risk, unlawful activity, a serious client breach or an overdue payment, but only to the extent permitted by the relevant agreement and law. Where appropriate, we will give notice and a reasonable opportunity to resolve the issue.

If you are a consumer purchasing services remotely or away from business premises, statutory cancellation rights may apply. Whether those rights apply, the cancellation period and any exceptions depend on the circumstances and applicable consumer law. Any required cancellation information will be provided where applicable.

Nothing in these terms removes mandatory cancellation rights or other consumer protections.

15 Complaints and Dispute Resolution

If you have a concern about our website or services, please contact us first so we can understand the issue and attempt to resolve it.

Please include your name, relevant project or invoice reference if applicable, a description of the issue and the outcome you are seeking. We will review the information and respond within a reasonable time.

If a dispute cannot be resolved informally, the parties may consider appropriate legal remedies or any alternative dispute resolution process available under applicable law.

16 Changes to These Terms

We may update these website terms from time to time, for example to reflect changes to our services, website or legal obligations.

The updated version will be published on this page with a revised update date. Changes will apply prospectively to website use from the date they take effect, subject to applicable law.

An update to these website terms will not automatically amend an existing client agreement. Any changes to an existing project agreement must be handled in accordance with that agreement and applicable law.

17 Governing Law and Jurisdiction

These website terms and any non-contractual obligations arising from them are intended to be governed by the laws of England and Wales, subject to any mandatory legal protections that apply to you.

Any dispute will be subject to the jurisdiction of the courts of England and Wales where legally appropriate. If you are a consumer residing elsewhere, mandatory rights or jurisdictional protections under applicable law may also apply.

A separate client agreement may contain additional provisions about governing law and dispute resolution.
